Wages and Overtime

The Fair Labor Standards Act (FLSA) requires hourly employees to be paid for every hour worked and entitles them to overtime pay for any time worked in excess of 40 hours during a work week. Training time should always be compensated; travel time may be as well.

Some employers require hourly employees to perform work "off the clock," such as working at home, working during lunch, and working before or after official work hours. This is a violation of the FLSA. Salaried employees may also be entitled to overtime wages if the employer mistakenly considers them exempt from the FLSA.
